Overview
These Terms of Use (the “Terms”) are presented by Clarity Traders LLC, a limited liability company organized and existing under the laws of the State of Delaware, United States, with its registered office at 8 The Green, Suite B, Dover, Delaware 19901, USA (“Clarity Traders,” the “Company,” the “Provider,” “we,” “us,” or “our”).
These Terms govern the relationship between Clarity Traders and you, the individual or legal entity accessing or using any challenges, evaluations, simulated trading programs, funded account programs, dashboards, platforms, tools, or other services provided by Clarity Traders (the “Customer,” “you,” or “your”), collectively referred to as the “Services.”
The Services are primarily accessible through www.claritytraders.com, prop.claritytraders.com, and any other websites or domains operated by Clarity Traders (collectively, the “Website”).
The Customer is strongly encouraged to read these Terms carefully. The Customer is not obligated to use the Services if the Customer does not agree with or understand any part of these Terms. By accessing the Website, registering an account, purchasing a Challenge, or otherwise using the Services, the Customer confirms acceptance of and agreement to be bound by these Terms.
IMPORTANT LEGAL NOTICE – NO INVESTMENT SERVICES
NONE OF THE SERVICES PROVIDED BY CLARITY TRADERS CONSTITUTE INVESTMENT SERVICES, BROKERAGE SERVICES, OR FINANCIAL ADVICE.
Clarity Traders does not provide trading advice, investment recommendations, portfolio management, or any guidance regarding how or in what manner trades should be executed. All trading activity takes place in a simulated environment. Any information provided by Clarity Traders or its representatives shall not be considered investment advice, and any such interpretation is expressly disclaimed.
Section 1 – Online Registration & Eligibility
By using the Services, the Customer represents and warrants that:
- The Customer is at least 18 years of age or the age of legal majority in their jurisdiction.
- The Customer resides in a jurisdiction where the Services are lawfully offered.
- The Customer’s participation does not violate any applicable laws, regulations, or rules.
Clarity Traders reserves the right to refuse service to any person or entity at any time and for any reason, at its sole discretion.
Section 2 – General Conditions
The Customer agrees not to use the Services for any unlawful, unauthorized, or prohibited purpose. Any violation of these Terms may result in immediate suspension or termination of access.
The headings used in these Terms are included for convenience only and shall not affect the interpretation or construction of any provision.
Section 3 – Information Accuracy, Completeness, and Timeliness
The Customer acknowledges that the Services, Website content, and related information are provided “as is” and may contain inaccuracies, errors, delays, or omissions.
Clarity Traders makes no representation that the information provided is accurate, complete, current, or reliable. The Customer agrees that reliance on such information is entirely at the Customer’s own risk.
Section 4 – Changes to Services and Pricing
Prices, features, parameters, rules, and availability of Services are subject to change without notice.
Clarity Traders reserves the right to modify, suspend, or discontinue any aspect of the Services at any time. The Company shall not be liable to the Customer or any third party for any modification, price change, suspension, or discontinuance.
Section 5 – Nature of Services (Simulated Trading)
All Challenges, Evaluations, Verifications, and Funded Accounts operate in a simulated trading environment.
Any funds, balances, profits, or losses displayed are virtual, have no monetary value, and do not represent real capital owned by the Customer.
Clarity Traders may, at its discretion, replicate simulated trades to proprietary or third-party accounts for internal purposes. The Customer has no ownership or claim over such accounts.
Section 6 – Account Information & Billing Accuracy
The Customer agrees to provide accurate, complete, and current information when registering or purchasing Services.
Clarity Traders reserves the right to refuse or cancel any order, limit quantities, or restrict access where activity appears abusive, fraudulent, or inconsistent with these Terms.
Section 7 – Fees, Payments & No Refund Policy
The Customer must pay a one-time evaluation fee to access the Services.
ALL PAYMENTS ARE FINAL AND NON-REFUNDABLE, regardless of outcome, performance, or early termination.
Any chargeback, dispute, or reversal constitutes a material breach of these Terms and may result in immediate termination, forfeiture of profits, and permanent restriction from future Services.
Section 8 – Third-Party Tools and Platforms
Clarity Traders may provide access to third-party tools, platforms, or software over which it has no control.
Such tools are provided “as is” and “as available.” Clarity Traders assumes no liability for issues arising from their use.
Section 9 – External Links
The Website may contain links to third-party websites. Clarity Traders is not responsible for the content, accuracy, or practices of any third-party websites.
Use of third-party services is entirely at the Customer’s own risk.
Section 10 – User Comments, Feedback, and Submissions
The Customer agrees that any feedback, comments, or submissions provided to Clarity Traders may be used, reproduced, distributed, or published without restriction or compensation.
Clarity Traders has no obligation to maintain submissions in confidence or to respond.
Section 11 – Errors, Inaccuracies, and Omissions
Clarity Traders reserves the right to correct errors, inaccuracies, or omissions at any time, including after an order has been placed.
The Customer must report any technical or trade-related issues promptly. Failure to do so may result in waiver of claims.
Section 12 – Prohibited Uses and Trading Practices
The Customer is prohibited from engaging in activities including but not limited to:
- Exploiting system errors or latency
- Hedging or coordinating across accounts
- Market manipulation or abusive trading
- Any activity creating financial, operational, or reputational risk
Clarity Traders retains sole discretion to determine violations and apply remedies.
Section 13 – Profit Sharing & Withdrawals
Profit sharing is a contractual reward, not an entitlement or investment return.
Payments are subject to ongoing compliance, KYC verification, and discretionary review. Clarity Traders may delay, deny, or adjust payments where violations are suspected.
Section 14 – Restricted Jurisdictions
The Services are not available in certain jurisdictions, including countries subject to sanctions or regulatory restrictions.
The Customer is solely responsible for determining eligibility.
Section 15 – Disclaimer of Warranties
The Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose.
Section 16 – Limitation of Liability
To the maximum extent permitted by law, Clarity Traders shall not be liable for any direct, indirect, incidental, punitive, special, or consequential damages, including lost profits or data, regardless of legal theory.
Section 17 – Indemnification
The Customer agrees to indemnify, defend, and hold harmless Clarity Traders and its affiliates from any claims, damages, losses, or legal fees arising from the Customer’s breach of these Terms or misuse of the Services.
Section 18 – Severability
If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
Section 19 – Termination
Clarity Traders may terminate or suspend access to the Services at any time, with or without notice. Obligations incurred prior to termination shall survive.
Section 20 – Governing Law & Local Law Compliance
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States.
The Customer is responsible for compliance with all local laws applicable to their participation.
Section 21 – Changes to Terms & Contact Information
Clarity Traders reserves the right to modify these Terms at any time. Continued use constitutes acceptance.
